Avery appeal: attorney files 1,000-page motion

MANITOWOC – One of the attorneys handling Steven Avery’s appeal of his conviction for the murder of commercial photographer Teresa Halbach filed a motion on Wednesday, June 7, in Manitowoc County Circuit Court. It seeks the vacation of the conviction and Avery’s release from prison.

Among the allegations in the document:

  1. There is new evidence that favors Avery, and indications that some evidence used at trial was planted.

  2. Former Calumet County District Attorney Ken Kratz fabricated evidence against Avery and prosecuted the case unethically.

  3. The prosecution withheld evidence that it knew was favorable to the defense, something prosecutors are prohibited from doing.

  4. Avery’s attorneys at trial did not represent him effectively.

Zellner says that these allegations are new, and so this motion should not be barred as something that repeats points of earlier appeals that were already hard and dismissed.

The new motion will be handled first in Manitowoc County Circuit Court because the trial was heard there.
